ORDINANCE #358 REZONING OF PROPERTY RECENTLY ANNEXED INTO THE CITY OF PERHAM LOCATED AT 850 EAST MAIN AN ORDINANCE REVISING ORDINANCE NO. 286 ENTITLED LAND USE (ZONING) CITY OF PERHAM, MINNESOTA Section 1. The City Council of the City of Perham, Minnesota hereby ordains as follows: The following described property is hereby rezoned from Open (O) to Light Industrial (LI) to accommodate continued and consistent development of the area within the City of Perham. Description of Property to be Rezoned That part of the west 35.5 rods of the east 61.5 rods, lying south of the Northern Pacific Railway right of way, except Sublot 2, lying in Section 14, Township 136, Range 39, and excepting those tracts thereof conveyed by former deed to Herbert Kath and Lorraine Kath, husband and wife, consisting of a plot of ground beginning at that point at which the Southeast boundary of Sublot 2 intersects the Southwest boundary of U.S. Highway #10, thence running Southeast along said Southwest boundary of U.S. Highway 100 feet, thence continuing along this line a distance of 129 feet, thence Southwesterly a distance of 150 feet at right angles to the said highway; thence parallel to said highway a distance of 243 feet to the Southeast boundary line of Sublot 2; thence northeasterly a distance of 150 feet to the point of beginning and there terminating. Containing approximately 9.41 acres. EXCEPT: Grantors' undivided ½ interest in an 80.00 foot wide strip of land being a par of the Southwest Quarter of the Southeast Quarter of Section 14, Township 136 North, Range 39 West of the Fifth Principal Meridian in Otter Tail County, Minnesota. The centerline of said 80.00 foot wide strip of land is described as follows: Commencing at an iron monument which designates the south quarter corner of said Section 14; thence South 88 degrees 19 minutes 42 seconds East 600.73 feet on an assumed bearing along the south line of said Section 14 to the point of beginning of the centerline of said 80.00 foot wide strip of land; thence North 05 degrees 24 minutes 38 seconds East 394.58 feet; thence northerly on a curve concave to the east, having a central angle of 33 degrees 26 minutes 31 seconds and a radius of 350.00 feet for a distance of 204.29 feet (chord bearing North 22 degrees 07 minutes 54 seconds East); thence North 38 degrees 51 minutes 09 seconds East 105.33 feet to the southwesterly right of way line of County State Aid Highway No. 80 (old Trunk Highway No. 10) and said centerline there terminates. The sidelines of said 80.00 foot wide strip of land shall be prolonged or shortened to terminate on the south line of said Section 14 and on the southwesterly right of way line of said County State Aid Highway No. 80 (old Trunk Highway No. 10). and EXCEPT That part of the Southwest Quarter of the Southeast Quarter of Section Fourteen (14), Township One Hundred Thirty-six (136), North, Range Thirty-nine (39) West of the Fifth Principal Meridian in Otter Tail County described as follows: Commencing at a found iron monument which designates the south quarter corner of said Section 14; thence South 88° 19' 42" East 640.82 feet on an assumed bearing along the south line of said Section 14 to the easterly line of East Coney Street; thence North 05° 24' 38" East 391.95 feet along the easterly line of said Seventh Avenue Northeast to the point of beginning; thence continuing North 05° 24' 38" East 33.00 feet along the easterly line to said Seventh Avenue Northeast; thence northerly continuing along the easterly line of said East Coney Street on a curve concave to the east, having a central angle of 33° 26' 31" and a radius of 310.00 feet, a distance of 180.94 feet (chord bearing North 22° 07' 54" East); thence North 38° 51' 09" East 105.36 feet continuing along the easterly line of said East Coney Street to the southwesterly line of C.S.A.H. No. 80 Right of Way Plant NO. 7, said plan is on file and of record in the office of the Recorder of said County; thence South 51° 10' 56" East 178.55 feet along the southwesterly line of said plan; thence South 05° 17' 23" West 180.00 feet; thence North 87° 33' 48" West 259.16 feet to the point of beginning. together with all hereditaments and appurtenances belonging thereto, subject to the following exceptions: Easements, restrictions, and reservations of records, if any Section 2. This ordinance will take full force and effect upon adoption and publication. Adopted by the City Council this 28th day of May, 2014.
